Waiver

Each attendee / ticket holder for NEST 2024 is required to read and agree to the terms listed below. After payment, you will be sent an email with a direct link to a form to complete and sign stating you have read and agree to these terms.

WARNING: THIS IS A WAIVER AND RELEASE OF LIABILITY. DO NOT SIGN OR INITIAL IT IF YOU HAVE NOT READ IT COMPLETELY, DO NOT UNDERSTAND IT OR DO NOT AGREE WITH ANY OF ITS TERMS.

Your Signature and/or initials on these documents indicates that you have read completely, understand and agree to all of the following:

  1. I acknowledge that I wish and desire to voluntarily participate in and/or observe tickling, bondage and other sado-masochistic activities. I acknowledge that I may observe sexual or sexually suggestive activity and/or imagery and that I do so voluntarily.
  2. I understand that tickling, bondage and other sadomasochistic activities involve certain real and unpredictable risks that can not be eliminated regardless of the care taken to avoid injuries. I am cognizant of and fully understand the risks and dangers inherent with the activities in which I and others will be participating and acknowledge that I am physically, mentally, emotionally and psychologically fully capable of participating in the activities and/or observing these activities. I fully assume the risks and dangers as acceptable to me, and I agree to use my best judgment in undertaking these activities, and I agree to follow all rules and regulations of NEST or the host facilities and any safety instructions.
  3. I understand and agree that any bodily injury, death, or loss of personal property and expenses as a result of my own intentional or negligent act(s), or the intentional or negligent act(s) of any other person(s) participating in any scheduled and planned, or unscheduled or unplanned activity, or as a result of the failure or malfunction of any piece(s) of equipment or devices, is my responsibility and I accept same. I also state and acknowledge that the activities associated with tickling, bondage and other sadomasochism involve risk of injury from or resulting in bruises, contusions, lacerations, and severe contortion of the human body and that the foregoing list of possible injuries and injurious acts is neither complete nor exclusive.
  4. I understand that accidents may occur, mistakes may be made, equipment and devices may fail or malfunction and that the premises in which I desire to participate in tickling, bondage and other sadomasochistic activities do not include medical facilities and that injuries may be aggravated by delay in receiving medical attention. In consideration of the right to participate in tickling, bondage and other sadomasochistic activities, and any other activities in which I may participate, I hereby certify that I am in good physical, mental, emotional and psychological health with no defects that might be injurious to me and that I am able to handle the hazards of tickling, bondage and other sadomasochistic activities and any conditions that may be associated with such activities or with observation of these activities.
  5. As partial consideration for being permitted to participate in and/or observe tickling, bondage and other sadomasochistic activities, scheduled, planned, unscheduled or unplanned, I hereby waive and release from any legal liability and agree not to sue, claim against the property of, or prosecute and to indemnify and hold harmless NEST, its directors, associates, agents, sponsors, contractors, assistants, guests, licensees and invitees, for any and all claims, actions, suits, costs, expenses (including attorneys fees) damages or liabilities for personal injury or death, damage, accidents, illnesses, or any incidental damages caused by or resulting from my participation in tickling, bondage and other sadomasochistic activities, use of the host facilities or equipment and/or from injuries or any occurrence resulting from my choice to not read, disregard or ignore posted signs in, on or around the host facilities.
  6. This Waiver and release shall be binding upon my heirs, my estate, assigns, executor(s), legal guardian, my personal representatives and me.
  7. I have carefully read this Waiver and Release and fully understand its contents. I am aware that I am releasing legal rights that I otherwise may have and I enter into this Waiver and Release of my own free will and volition and with full comprehension and awareness of the risks involved. I intend by my signature below that this is a complete and unconditional release of all liability to the greatest extent allowed by law.
